Hmm.

As near as I can tell just moving the action into a function changed nothing:

        Mouse 3 W M Function MoveWindow

        DestroyFunc MoveWindow
        AddToFunc MoveWindow I Current Move

Am I completely clueless? The behaviour still obtains on mouse-release only.
